A minor must be provided with at least 3 hours of schooling per day while minor’s school is in session
Children in grades 2-6 must be instructed between 8:00 a. m. and 4:00 p. m. Students in grades 7-12 can be instructed between 8:00 a.m. and 7:00 p.m.
Minor may not be called to set earlier than 5:00 a.m.
Minor may not work later than 10:00 p.m. on school day and 12:30 a.m. on non-school day.
12 hours from wrap time to next day’s call time.
If school starts less than 12 hours from wrap time, minor must be schooled on set.
CHILD ATTENDING REGULAR SCHOOL AND WORKING
If child attends his/her own school prior to reporting to his/her place of employment time spent in regular school will be considered 6 hours regardless of time actually spent
Required 1 hour of rest & recreation will be allocated to that 6-hour period
Child will be permitted, therefore, at place of employment for 2-1/2, 3-1/2, or 4-1/2 hours, depending on age of child times permitted at place of employment will include 1/2 hour meal period.
Travel time between school and studio is not considered work time.
MINORS GRADUATED FROM HIGH SCHOOL (also referred to as “Legal 18”)
If a minor sixteen (16) to eighteen (18) years of age has satisfied the educational requirements of the State of California (i. e., GED, Proficiency Certificate, or high school diploma):
* no entertainment work permit is needed
* no studio teacher is required
* he/she may be employed for the same hours as an adult employed performing the same work
Any minor under the age of 18 years who has filed for emancipation must still receive 3 hours of schooling if they have not received high school diploma
Emancipated minor may still be subject to child labor laws.
To be used only when combined work/school schedule is unusually heavy.
* All time to be under immediate supervision of studio teacher
* “Homework” not to be counted as banked time
* May take place on school holidays, during school vacation, or on regular days when scheduled work time is less than permitted for age of child in question
* Maximum hours banked on vacation day/holiday is 4 hours for grades 1-6, and 5 hours for grades 7-12
* If child is working, hours banked would be limited to total amount of combined work/school time permitted for age of child in question
* NO BANKED TIME DURING SUMMER VACATION
* When school is in session, maximum banked will be:
* for grades 1-6: 1 hour
* for grades 7-12: 2 hours
* 1 hour instruction minimum each school day; therefore, not more than 2 hours banked time to be used in one work day in lieu of required 3 school hours
* Banked time not to exceed 10 hours per month and must be within days of time banked
* A record of when the instruction time was banked and when it was used must be kept
If child is scheduled to work until 10 p.m. on a night preceding a school day 3 hours of school is to be completed by 4 p.m.; therefore, call time cannot be later than 1 p. m unless child uses banked hours.
Minors may not be around guns with blanks or any explosives.
Minors cannot have squibs – blood packs.
Stunts and Hazardous Conditions
1. If a minor is asked to perform any activity that seems hazardous or questionable, the minor is entitled to have the activity performed by a qualified stunt person.
2. It should never be the sole decision of the producer, director, stunt supervisor or any crew member that any activity is safe enough for the child to perform.
3. It is the minor’s parent’s primary and most important responsibility to ensure the safety of their child.
4. The minor or the minor’s parents always has the right to refuse to perform any activity that might be hazardous to the minor, either physically or emotionally.
5. If the minor believes the situation is dangerous or is fearful (whether real or imagined) the minor cannot be required to perform.
6. Parents should request a stunt and safety expert, if the minor is to perform the activity, or a stunt double if necessary.
7. Minors should be acquainted with all first aid personnel (required on all SAG productions) and procedures immediately on arrival.
8. Outdoor shoots often require long periods of time in the elements. Parents should guard minors against dehydration, hypothermia and overexposure to the sun. Parents should not hesitate to contact first aid personnel immediately if the minor is too wet, too cold or too tired.
9. No minor should work in any of these situations without careful supervision by trained technicians and medical personnel.
10. Parents should consider the impact of mature or emotionally difficult dialogue or actions on their child’s well being. Only the parent knows what their child can tolerate and therefore MUST ensure their well-being.

WORKING HOURS FOR MINORS
INFANTS 15 DAYS TO 6 MONTHS
Maximum 21/2 hours at place of employment
No more than 20 minutes of work time
Work time limited to 2 consecutive hours between 9:30 a.m. – 11:30 a.m. or 2:30 p.m. – 4:30 p.m.
No exposure to light of greater than 100 foot-candle intensity for more than 30 seconds at a time
Presence of nurse and studio teacher
For babies 15 days to 6 weeks, one nurse and 1 studio teacher for 3 or fewer babies
For babies 6 weeks to 6 months, one nurse and 1 studio teacher for 4 to 10 babies
An “adequate facility” is an area removed from the work site where the baby can eat and/or sleep without being held.
BABIES 6 MONTHS TO 2 YEARS
Maximum 4 1/2 hours at place of employment.
No more than 2 hours of work time.
If studio teacher determines that a child is uncomfortable and hungry, studio teacher may require that an earlier meal period be given.
2 THRU 5-YEAR-OLD
Maximum 6 1/2 hours at place of employment.
No more than 3 hours of work time.
Pre-schooler (under 6 years of age) may work, with approval of parent or guardian and studio teacher, until 12:30 a.m. on any night as long as his/her allowable hours at place of employment are not extended.
6 THRU 8-YEAR-OLDS
Maximum 8 1/2 hours at place of employment.
No more than 4 hours of work time on school day, 6 hours on non-school day.
Must complete 3 hours of school on set.
When a 6- thru 8-year-old attends his/her own school prior to reporting to work, he/she may be at place of employment for 2-1/2 hours, which includes a 30-minute meal period.
9 THRU I5-YEAR-OLDS
Maximum 9 1/2 hours at place of employment
No more than 5 hours of work time on school day, 7 hours on non-school day.
Must complete 3 hours of school on set.
When a 9- thru 15-year-old attends his/her own school prior to reporting to work, he/she can be at place of employment for 3-1/2 hours, which includes a 30-minute meal period.
16- and I7-YEAR-OLDS
Maximum 10 1/2 hours at place of employment
No more than 6 hours of work time on school day, 8 hours on non-school day.
When a 16 or 17-year old attends his/her own school prior to reporting to work, he/she may be at the place of employment for 4 1/2 hours, which includes a 30 minute meal period.
For 16 or 17 year-olds, studio teachers are required for education only.
No Studio Teacher needed in summer for 16 or 17 year-olds.
Parents/guardians need not accompany 16 or 17 year-olds on set or location.
If minor has satisfied the educational requirements of the State of California (diploma, GED, Proficiency), neither an entertainment work permit nor a studio teacher is required and the minor may work the same hours as an adult.
Minors 16 or 17 need an entertainment work permit but under the following circumstances a studio teacher is not required:
* If the emancipation documents of the minor specifically exempt that minor from the provisions of the Labor Code and the Education Code
* If the minor has completed the required amount of educational instruction for the day.
EXTENDING WORKING HOURS IN CERTAIN CIRCUMSTANCES
If a minor between the ages of 8 to 18 years is employed in a theater, motion picture studio, radio broadcasting studio, or television studio, before 10:00 p. m., in presentation of a performance, play, or drama continuing from an earlier hour until after 10:00 p.m., to continue his part in such presentation between the hours of 10:00 p.m. and 12:00 midnight.
MISCELLANEOUS – Screen Test – If minor paid, must have studio teacher.
A minor of 14 to 18 years may work up to 8 hours of 2 consecutive days without schooling,
if written permission given by his school.
A minor may work after going to school, in which case school counts as 6 hrs. towards work time
and a studio teacher required for welfare.
A minor may work 1 hr. after school without a teacher for looping, wardrobe, publicity or
NUMBER OF STUDIO TEACHERS:
1 for every 10 babies, or students (when school in session).
1 for every 20 students when school is not in session
1 teacher and 1 nurse for any 3 babies from 15 days to 6 weeks old.
1 teacher and 1 nurse for any 10 babies from 6 weeks to 6 months old. Parents or guardians are responsible for bringing the child’s school books and assignments. In order to ensure as smooth a transition as possible when a minor’s regular classroom instruction is interrupted by work, arrangements should be made with the child’s home school prior to the start of production.
